1. Acceptance of terms
By accessing or using SGP (SmartGymPilot) ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.
2. Description of service
SGP provides gym and fitness studio management tools, including member management, expiry tracking, renewal reminders, subscriptions, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.
3. Account and eligibility
You must be at least 18 years old and have the authority to bind your gym or organisation. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate registration information and keep it up to date.
4. Subscription and payment
Paid plans are billed in advance (e.g. monthly or annually) as described on our pricing page. Fees are non-refundable except where required by law or as stated in our refund policy. We may change pricing with notice; continued use after a price change constitutes acceptance. You may cancel your subscription at any time; access continues until the end of the current billing period.
5. Acceptable use
You agree not to use the Service for any illegal purpose or in violation of any applicable laws. You must not attempt to gain unauthorised access to the Service or others' accounts, transmit malware, or use the Service in a way that could harm, overload, or impair our systems or other users. We may suspend or terminate accounts that violate these terms.
6. Your data and privacy
You retain ownership of the data you submit. Our collection and use of personal data is described in our Privacy Policy. We process your data to provide and improve the Service and as set out in that policy.
7. Intellectual property
SGP (SmartGymPilot) and its licensors own all rights in the Service, including software, design, and branding. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business use in accordance with these Terms. You may not copy, modify, or create derivative works of the Service without our written permission.
8. Disclaimers
The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose. To the fullest extent permitted by law, we disclaim all warranties, express or implied. We are not liable for any decisions you make based on data or reports from the Service.
9. Limitation of liability
To the maximum extent permitted by law, SGP (SmartGymPilot) and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claims arising from or related to the Service shall not exceed the fees you paid to us in the twelve (12) months preceding the claim.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or for other operational or legal reasons. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g. liability limits, indemnity) will survive.
11. Governing law and disputes
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India. If any provision is held invalid, the remaining provisions remain in effect.
